{"id":8826,"date":"2022-07-13T15:56:25","date_gmt":"2022-07-13T19:56:25","guid":{"rendered":"https:\/\/env-8605394.mightybox.site\/?post_type=news&#038;p=8826"},"modified":"2024-09-24T13:42:44","modified_gmt":"2024-09-24T17:42:44","slug":"dhs-ends-temporary-covid-19-policy-for-form-i-9-expired-documents","status":"publish","type":"post","link":"https:\/\/techservealliance.org\/dhs-ends-temporary-covid-19-policy-for-form-i-9-expired-documents\/","title":{"rendered":"DHS Ends Temporary COVID-19 Policy for Form I-9 Expired Documents"},"content":{"rendered":"\n<p>On May 1, 2022, the U.S. Department of Homeland Security (DHS) ended the&nbsp;<a href=\"https:\/\/www.uscis.gov\/i-9-central\/form-i-9-related-news\/covid-19-temporary-policy-for-list-b-identity-documents\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">COVID-19 Temporary Policy for List B Identity Documents<\/a>. As a result, employers are no longer allowed to accept expired&nbsp;<a href=\"https:\/\/www.uscis.gov\/i-9-central\/form-i-9-resources\/handbook-for-employers-m-274\/120-acceptable-documents-for-verifying-employment-authorization-and-identity\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">List B<\/a>&nbsp;documents when individuals fill out their&nbsp;<a href=\"https:\/\/www.uscis.gov\/i-9-central\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Form I-9<\/a>. In addition, if an employee presented an expired List B document between May 1, 2020, and April 30, 2022,&nbsp;<strong>employers are required to update their Form I-9 by July 31, 2022<\/strong>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Temporary Policy<\/strong><\/h5>\n\n\n\n<p>DHS issued the temporary policy in response to the challenges many individuals experienced with renewing List B documents during the COVID-19 pandemic.<\/p>\n\n\n\n<p>Now that document-issuing agencies have reopened and provide alternatives to in-person renewals, the DHS has ended this flexibility. Employers will need to update Form I-9 for employees who used expired documents from List B.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Required Form I-9 Updates<\/h5>\n\n\n\n<p>Employers must use the \u201cAdditional Information\u201d field in the form\u2019s Section 2 to enter the title, issuing authority, number, and expiration date of the unexpired document. Employees may present a renewed List B document, a different List B document or a document from&nbsp;<a href=\"https:\/\/www.uscis.gov\/i-9-central\/form-i-9-resources\/handbook-for-employers-m-274\/120-acceptable-documents-for-verifying-employment-authorization-and-identity\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">List A<\/a>. Employers must also initial and date these changes.<\/p>\n\n\n\n<p>Employers should note that no action is required for individuals who used expired List B documents if:<br>\u2022 They are no longer employed; or<br>\u2022 The List B document was auto-extended by the issuing authority (the document is considered unexpired when presented).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Important Dates to Remember<\/h5>\n\n\n\n<p><strong>May 1, 2022<\/strong><br>The expiration date of the DHS temporary policy that allowed employers to accept expired documents from the Form I-9 B list.<\/p>\n\n\n\n<p><strong>July 31, 2022<br><\/strong>Deadline for employers to update Form I-9 for employees who used expired documents from List B.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On May 1, 2022, the U.S. Department of Homeland Security (DHS) ended the&nbsp;COVID-19 Temporary Policy for List B Identity Documents.
