{"id":9828,"date":"2022-10-19T14:14:47","date_gmt":"2022-10-19T18:14:47","guid":{"rendered":"https:\/\/env-8605394.mightybox.site\/?post_type=news&#038;p=9828"},"modified":"2024-09-24T13:45:29","modified_gmt":"2024-09-24T17:45:29","slug":"staffing-agency-pays-550000-to-settle-discrimination-claims","status":"publish","type":"post","link":"https:\/\/techservealliance.org\/staffing-agency-pays-550000-to-settle-discrimination-claims\/","title":{"rendered":"Staffing Agency Pays $550,000 to Settle Discrimination Claims"},"content":{"rendered":"\n<p>On October 3, 2022, the&nbsp;<a href=\"https:\/\/www.eeoc.gov\/newsroom\/staffing-solutions-pay-550000-settle-eeoc-discriminatory-hiring-and-placement-suit\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Equal Employment Opportunity Commission (EEOC) announced<\/a>&nbsp;a settlement in an expansive employment&nbsp;<a href=\"\/storage.courtlistener.com\/recap\/gov.uscourts.nywd.117388\/gov.uscourts.nywd.117388.1.0_4.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">discrimination lawsuit<\/a>&nbsp;filed in 2018 against Buffalo, NY-area staffing agency, Staffing Solutions of WNY Inc. The&nbsp;<a href=\"\/storage.courtlistener.com\/recap\/gov.uscourts.nywd.117388\/gov.uscourts.nywd.117388.1.0_4.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a>&nbsp;describes a pattern of shocking, discriminatory conduct by the CEO.<\/p>\n\n\n\n<p>According to the&nbsp;<a href=\"https:\/\/www.staffing-wny.com\/job-placement\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">company website<\/a>, Staffing Solutions places workers seeking temporary, part-time, or full-time \u201cemployment in industrial, warehouse, shipping and receiving, and clerical positions.\u201d<\/p>\n\n\n\n<p>While Staffing Solutions does not place IT and engineering solutions professionals, the case reminds all staffing firms to have clear, effective anti-discrimination, and anti-harassment policies and channels to report violations. Staffing firms cannot discriminate against their own employees nor comply with discriminatory hiring requests from clients.<\/p>\n\n\n\n<p>HR Drive, \u201c<a href=\"https:\/\/www.hrdive.com\/news\/eeoc-staffing-firms-discriminatory-hiring-requests\/633984\/?utm_source=Sailthru&amp;utm_medium=email&amp;utm_campaign=Issue:%202022-10-14%20HR%20Dive%20%5Bissue:45255%5D&amp;utm_term=HR%20Dive\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">EEOC: Staffing Firms Cannot Acquiesce to Discriminatory Hiring Requests<\/a>,\u201d 10\/13\/2022<\/p>\n\n\n\n<p>The EEOC\u2019s lawsuit charged that Staffing Solutions engaged in multiple hiring practices that violated \u201cTitle VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, and the Age Discrimination in Employment Act, which prohibit dis\u00adcrimination based on age, disability, race or sex, as well as retaliation.\u201d According to the EEOC press release, Staffing Solutions discriminatory practices included complying with clients\u2019 race and sex preferences; refusing to hire highly qualified Black applicants or placing them in lowest paying, least desirable jobs; rejecting pregnant and over 50 applicants; and asking applicants about medical conditions and using that information not to hire them.
